  1. ACCEPTANCE OF TERMS

Welcome to Odesya. By creating an account on our Website and using our services, you confirm your acceptation of these Terms and Conditions (“TAC”).  Odesya reserves the right to update and change the TAC from time to time without notice or acceptance by you.

  1. DESCRIPTION OF SERVICE

2.1 In order to use our Service, you must have Internet access and the necessary equipment such as a computer or any other device. You shall bear all the expenses and fees associated to your Internet access anwithequipment.

2.2 You agree to access the Service only through the interfaces provided by Odesya.

  1. REGISTRATION AND ACCOUNT SECURITY

3.1 You must use a valid Odesya Username to access our Service. To do so, you must create an account on our Website and provide Odesya with a valid email address and other information.

3.2 You can then choose a password and a Username for your Profile. You are responsible for the confidentiality of your password and account, as well as for all activities on your account.

3.3 You convene to immediately notify Odesya of any unauthorized use of your password or account or any other security issue.

3.4 Odesya won’t be liable for any loss or damage arising from your failure to comply with this Section 3.

3.5 If Odesya suspects that you provided inaccurate or misleading information, Odesya has the right to suspend or suppress your account.

3.6 Each Account must belong to one individual person.

  1. CANCELLATION AND TERMINATION

4.1 If you decide to cancel the Service, your decision will apply immediately. You won’t be able to access your Account and Profile anymore and we will delete all the information you posted there.

4.2 Odesya isn’t liable for such information deletion. You also agree that Odesya, in its sole discretion, may suppress your password and/or account and the information associated with them, for any reason, including and without limitation if Odesya thinks that you have not respected these Ts & Cs.

4.3 Odesya may also, in its sole discretion and at any time, discontinue providing the Service, with or without notice.

  1. ODESYA PRIVACY POLICY

Registration Data and certain other information about you are subject to our Privacy Policy, which is incorporated into these TAC by reference. We invite you to carefully read it in conjunction with these TAC

  1. CONTENT AND CONDUCT RULES AND OBLIGATIONS

6.1 You understand that all information posted on your Account, including data, text, music, sound, photographs, graphics, video, messages or other materials (hereafter the “Content”), are your sole responsibility.

6.2.  Odesya does not control the Content posted on its website and thus cannot guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive or indecent.

6.3. Be aware that Odesya does not filter the Content, but keep in mind that Odesya has the right, in its sole discretion, to refuse, move, amend or suppress any Content that is available via the Service. You agree that Odesya may keep Content and may also disclose Content if this is required by law or if it believes that it is necessary to comply with any legal process, enforcement of the TAC, resolve claims that any Content violates the rights of third-parties or if necessary to protect the rights, property, or personal safety of Odesya and its users.

6.4. You agree that you will not: (a) post or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy (such as any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially objectionable; (b) harm minors in any way; (c) steal the identity of any person or entity or make representations impersonating someone else ; (d) manipulate identifiers in order to hide the origin of any Content published on the website; (e) upload, post or otherwise transmit any Content that you do not have a right to transmit or Content of commercial nature; (f) upload, post or otherwise transmit any material that contains software viruses; (g) interfere with or disrupt the Service or disobey any requirements, procedures or regulations of networks connected to the Service; (h) “stalk” or otherwise harass another user; (i) promote or provide instructional information about illegal activities; (j) use the Service to promote another website or Service; (k) solicit passwords or personal identifying information for commercial or unlawful purposes from other users; (l) engage in commercial activities within Odesya or on behalf of Odesya without prior approval. (m) upload or link to any images depicting full or partial nudity, sexual activity, suggestion of sexual activity, pornography, illegal drug use, underwear, racist or hate symbols; (n) copy or reproduce images from the profiles of other Odesya users without their explicit prior consent.

  1. INTERNATIONAL USE

7.1 Though Internet is global by nature, you agree to comply with all local rules regarding online conduct and acceptable Content.

  1. ADVERTISERS

Users’ of Odesya Sites, Product or Services may receive advertisements from advertising partners. partners may use cookies to recognize your computer each time they send you an online advertisement. This privacy policy covers the use of cookies by Odesya and does not cover the use of cookies by any advertisers.

  1. LINKS

The Service may provide, directly or through or third parties, links to other website. As Odesya has no control over such websites, you agree that  Odesya is not responsible for their availability nor for any Content or other materials from such websites.

  1. INDEMNITY

You agree to indemnify and hold Odesya, and its subsidiaries, directors, employees or other partners harmless from any claim, including reasonable attorneys’ fees, by any third party due to or arising out of your Content, your use of the Service, your user activities, your violation of the TAC, whether you are a registered user or not.

  1. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that Odesya may have general practices concerning use of the Service and may modify them from time to time without notice to you.

  1. PROPRIETARY RIGHTS

12.1 You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contains proprietary and confidential information protected by intellectual property and other laws such as copyrights, trademarks, Service marks, patents or others.

12.2 You shall not modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

12.3 Unless otherwise agreed in writing by Odesya, any material, information or idea you transmit to Odesya by any means may be disseminated or used by Odesya or its affiliates without compensation or liability to you for any purpose whatsoever. However, this clause does not apply to Content or to personal information.

  1. DISCLAIMER OF WARRANTIES

13.1 You expressly understand and agree that your use of the Service is at your sole risk. Odesya expressly disclaims all warranties. Odesya does not warrant that the Service will meet your specific requirements. Odesya cannot guarantee that the Service will be uninterrupted, secure, or error-free or that the results from the use of the Service will be accurate or reliable.

13.2 Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

13.3  Odesya is not responsible for the conduct, whether online or offline of any user of the Odesya Services.

  1. CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

14.1 Odesya respects the intellectual property of others, and we ask our users to do the same. Odesya may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers.

14.2 If you believe that your work has been copied and that this is an incidence of copyright infringement or a violation of your intellectual property rights, please provide Odesya the following information: an electronic or physical signature of the owner of the copyright or other intellectual property interest; a description of the copyrighted work or other intellectual property that you claim has been infringed; a description of where the material that you claim is infringing is located on our website your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner.

  1. MEMBER DISPUTES

15.1 Member Disputes. You are solely responsible for your interactions with other Odesya members. in case a dispute arises between you and another user, Odesya reserves the right, but has no obligation, to arbitrate it.

  1. GENERAL

16.1 We may send you notices and information via email, regular mail or via the Private Message system. We may provide notices of changes to the TAC or other matters by displaying notices or links.

16.2 The TAC and the relationship between you and Odesya shall be governed by the laws of Korea without regard to its conflict of law provisions. You and Odesya agree to submit to the personal and exclusive jurisdiction of the courts located within Korea.

16.3 The failure of Odesya to exercise or enforce any right or provision of the TAC shall not constitute a waiver of such right or provision. The TAC is the entire agreement between you and  Odesya and governs your use of the Service.

16.4 You also may be subject to additional terms and conditions that may apply when you use affiliate or other Odesya Services, third-party Content or third-party software. If any provision of the TAC or incorporated documents are found by a competent court to be invalid, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TAC remain in full force and effect.

16.5 You agree that regardless of any statute or law to the contrary, any claim arising out of or related to use of the Service or the TAC must be filed within one (1) year after its occurrence.

  1. VIOLATIONS

Please report any violations of the Ts & Cs to us.
